These Terms & Conditions (“Terms”) govern your use of the Mamaqua Marketing website and the services provided by Mamaqua Marketing (“Mamaqua Marketing”, “we”, “us” or “our”).

By accessing our website, submitting an enquiry, requesting a quotation, accepting a proposal, or engaging our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or engage our services.


1. About Mamaqua Marketing

Mamaqua Marketing is a South African digital marketing business providing services that may include:

  • Website design and development
  • WordPress website development
  • Search Engine Optimisation (SEO)
  • Google Ads management
  • Facebook and Instagram advertising
  • Email marketing
  • Digital marketing strategy
  • Website maintenance
  • Digital marketing management and monthly retainers

The specific services provided to a client will be determined by the accepted quotation, proposal, scope of work or service agreement.


2. Website Use

You may use this website for lawful purposes only.

You agree not to:

  • Use the website for fraudulent or unlawful purposes.
  • Attempt to gain unauthorised access to the website or its systems.
  • Introduce malicious software, code or other harmful material.
  • Copy, reproduce or distribute website content without permission.
  • Interfere with the operation or security of the website.
  • Use information obtained from the website to carry out unlawful activities.

We reserve the right to restrict or terminate access to the website where we reasonably believe these Terms have been breached.


3. Enquiries and Quotations

Submitting an enquiry through our website does not create a client relationship or guarantee that Mamaqua Marketing will accept the project.

We may request additional information before providing a quotation or proposal.

Any quotation provided by Mamaqua Marketing will specify, where applicable:

  • Services to be provided
  • Project scope
  • Deliverables
  • Fees
  • Payment requirements
  • Estimated timelines
  • Maintenance requirements
  • Other applicable conditions

A quotation is not binding until it has been formally accepted by the client and any required deposit or initial payment has been received.


4. Project Scope

We will provide the services specifically described in the accepted quotation, proposal or agreement.

Requests outside the agreed scope may be treated as additional work and may result in additional charges.

Examples may include:

  • Additional website pages
  • Additional functionality
  • Additional revisions
  • New integrations
  • Additional content
  • Additional design work
  • Major structural changes
  • Additional advertising campaigns
  • Work caused by changes to previously approved requirements

Where reasonably possible, additional costs will be communicated to the client before the additional work is undertaken.


5. Website Design & Development

Website projects are developed according to the agreed scope and requirements.

Unless specifically stated otherwise, website development does not automatically include:

  • Professional photography
  • Videography
  • Copywriting beyond the agreed scope
  • Paid stock photography
  • Premium third-party software
  • Hosting
  • Domain registration
  • Paid advertising
  • Third-party subscription fees
  • Custom software development

Where third-party services, plugins, themes or software are required, the associated costs may be payable by the client.


6. Website Content

The client is responsible for providing accurate business information, images, logos, documents and other materials required for the project unless content creation is specifically included in the agreed scope.

The client confirms that they have the necessary rights or permissions to use materials supplied to Mamaqua Marketing.

Mamaqua Marketing is not responsible for copyright, trademark or other intellectual-property claims arising from materials supplied by the client.


7. Client Responsibilities

The client agrees to:

  • Provide accurate information and materials.
  • Provide required access to relevant accounts and systems.
  • Respond to requests for information or approvals within a reasonable period.
  • Review and approve website content and designs.
  • Provide timely feedback.
  • Ensure that supplied content is lawful and accurate.
  • Maintain valid ownership or authorisation for accounts and third-party services provided to Mamaqua Marketing.

Delays caused by missing information, access, approvals or client feedback may affect the project timeline.


8. Website Revisions

The number of revisions included in a project will depend on the agreed scope.

A revision means a reasonable change to an existing design or content element.

A complete redesign, change in project direction or new functionality may be treated as additional work.


9. Website Maintenance

Where a client subscribes to website maintenance, the maintenance service will cover the activities specifically agreed in the relevant package or service agreement.

Maintenance may include:

  • WordPress updates
  • Plugin updates
  • Theme updates
  • Security monitoring
  • Backups
  • Technical maintenance
  • Minor website content updates

Maintenance does not automatically include unlimited website development, redesigns or new functionality.

Major development work may be quoted separately.


10. Advertising Services

Mamaqua Marketing may manage advertising campaigns through platforms including Google Ads, Facebook and Instagram.

Advertising performance depends on factors outside our control, including:

  • Advertising platform algorithms
  • Competition
  • Market conditions
  • Audience behaviour
  • Search demand
  • Advertising policies
  • Budget
  • Client offer
  • Website performance
  • Creative quality

Mamaqua Marketing does not guarantee specific sales, leads, clicks, impressions, rankings or return on advertising spend.


11. Advertising Budget

Advertising spend paid to platforms such as Google or Meta is separate from Mamaqua Marketing’s professional management fee unless explicitly stated otherwise in the agreed package.

Where a package includes both advertising spend and management, the quotation will specify the applicable allocation.

Mamaqua Marketing may recommend changes to advertising budgets where campaign performance or market conditions justify doing so.


12. Advertising Platform Policies

Advertising campaigns are subject to the policies and approval processes of the relevant advertising platform.

Mamaqua Marketing cannot guarantee that an advertisement will be approved or remain approved by Google, Meta or another advertising platform.

If an advertisement, account or campaign is restricted, suspended or rejected due to platform policies, Mamaqua Marketing will take reasonable steps to identify and address the issue but cannot guarantee reinstatement.


13. SEO Services

SEO is an ongoing process influenced by search engines, competitors, website quality, content, technical factors and changes to search algorithms.

Mamaqua Marketing does not guarantee:

  • A specific Google ranking
  • A specific position in search results
  • A specific amount of organic traffic
  • A specific number of leads or sales

SEO recommendations and implementation will be based on available information and reasonable industry practices.


14. Email Marketing

Where email marketing services are provided, campaigns may be subject to the policies and technical limitations of third-party email platforms.

The client is responsible for ensuring that subscriber information provided to Mamaqua Marketing has been collected lawfully and that the client has the necessary permission to use such information.

Mamaqua Marketing may refuse to send campaigns where we reasonably believe the proposed activity may breach applicable law, platform policies or anti-spam requirements.


15. Fees and Payment

Fees and payment terms will be specified in the relevant quotation, proposal or agreement.

Unless otherwise agreed:

  • Work may commence once the required initial payment has been received.
  • Recurring services are billed according to the agreed billing cycle.
  • The client remains responsible for payment regardless of whether the client has used the completed service or deliverables.
  • Third-party costs are payable by the client where they are not included in the agreed fee.

Late payments may result in work being paused until the outstanding amount has been settled.


16. Monthly Retainers

For monthly digital marketing retainers, services will be provided according to the agreed scope and monthly objectives.

A monthly retainer does not mean that every service must receive an equal amount of work every month.

Mamaqua Marketing may prioritise activities based on:

  • Current business objectives
  • Campaign performance
  • Marketing opportunities
  • Website requirements
  • Available data
  • Campaign deadlines

Advertising spend and third-party software costs are excluded unless expressly stated otherwise.


17. Cancellation of Services

Where a client wishes to cancel an ongoing monthly service, the client must provide the notice period specified in the relevant service agreement.

Any outstanding amounts incurred before cancellation remain payable.

Cancellation does not automatically entitle the client to a refund for services already delivered.


18. Refunds

Because digital marketing and website services involve time, planning, development and professional work, fees for work already completed are generally non-refundable.

Where a refund is legally required or specifically agreed in writing, the applicable refund terms will apply.

Any refund request will be considered based on the circumstances, agreed scope and applicable law.


19. Intellectual Property

Unless otherwise agreed in writing, the client will receive the agreed final deliverables after all applicable project fees have been paid.

Mamaqua Marketing retains ownership of its:

  • Pre-existing materials
  • Processes
  • Templates
  • Methods
  • Frameworks
  • Proprietary systems
  • Reusable code or components

Third-party software, plugins, fonts, images and other licensed materials remain subject to their respective licence terms.


20. Portfolio & Marketing Use

Unless the client specifically requests otherwise in writing, Mamaqua Marketing may display completed website projects and other publicly available work in its portfolio and marketing materials.

We will not knowingly publish confidential client information or private business information without appropriate permission.

If a project contains confidential information, the client should notify us before publication.


21. Third-Party Services

Mamaqua Marketing may recommend or use third-party services including:

  • WordPress
  • Elementor
  • Crocoblock
  • Google
  • Meta
  • Hostinger
  • Email marketing platforms
  • Analytics platforms
  • Payment providers
  • Hosting providers

Third-party services are governed by their own terms, policies and service availability.

Mamaqua Marketing is not responsible for outages, policy changes, pricing changes, account restrictions or failures caused by third-party providers.


22. Website Availability

We aim to maintain a reliable website and service environment but do not guarantee uninterrupted availability.

The website may occasionally be unavailable due to:

  • Maintenance
  • Hosting issues
  • Security incidents
  • Technical failures
  • Third-party outages
  • Internet or network problems

23. Limitation of Liability

To the extent permitted by applicable law, Mamaqua Marketing will not be liable for indirect, incidental, consequential or unforeseeable losses arising from the use of our website or services.

This may include losses resulting from:

  • Lost revenue
  • Lost profits
  • Lost opportunities
  • Search-engine algorithm changes
  • Advertising platform changes
  • Third-party service interruptions
  • Website downtime
  • Account suspension
  • Advertising rejection
  • Cybersecurity incidents outside our reasonable control

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.


24. No Guarantee of Business Results

Marketing involves variables that cannot always be controlled.

Mamaqua Marketing will use reasonable professional efforts to deliver the agreed services but does not guarantee a particular level of:

  • Revenue
  • Sales
  • Leads
  • Website traffic
  • Advertising performance
  • Search rankings
  • Social media growth
  • Conversion rates

Results depend on factors including the client’s market, offer, pricing, competition, budget, customer behaviour and external platform changes.


25. Confidentiality

Both parties should treat confidential business information received during a project as confidential and should not disclose it to third parties except where:

  • Required by law
  • Necessary to provide the agreed service
  • Authorised by the relevant party
  • Already publicly available

This obligation may continue after the project ends.


26. Privacy

Personal information submitted through our website or provided during a project will be handled in accordance with our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect personal information.


27. Changes to These Terms

Mamaqua Marketing may update these Terms from time to time.

The latest version will be published on this website and will include the applicable Last Updated date.

Changes to the Terms will not automatically alter the terms of an existing signed agreement unless otherwise permitted or agreed.


28. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute relating to these Terms or our services will be subject to the jurisdiction of the applicable courts of South Africa.
